High Court of Cassation and Justice rejected the appeal brought by the senator Mircea Diaconu, Minister of culture, at the Bucharest Court of appeal decision by which it was established that the MP had been in a state of incompatibility.
Supreme court decision said that Mircea Diaconu is incompatible and, as of today, he no longer occupies a public office or dignity for three years.
The decision is irrevocable, may no longer be contested.
The magistrates of the Supreme Court, rejecting the appeal declared by Mircea Diaconu, have maintained the decision of the Court of Appeal, which found inconsistent during the period 2008-2011, when this held the posts of director at the Nottara Theatre and the senator in the Parliament of Romania.
According to the law , Mircea Diaconu should be dismissed from the leadership of the Culture Ministry , from the held public office.
His lawyers, at one time in the past, said that his duties as the director of the Nottara theatre of Mircea Diaconu were not administrative, his position was almost honorary, meaning that he set up the shows programmes or other minor issues.
