Spaces for sale, “exclusively for agricultural producers”
Starting January the 1st, all markets will have to have also space for sale for those who own a commercialization card of products, according to an ordinance draft.

All the 500 food markets existent in the country will have the obligation to organize distinct spaces for sale reserved exclusively to the agricultural producers, who own a commercialization card of agricultural products, according to draft emergency ordinance concerning the establishment of some measures of regulating the products on the market from the agricultural sector.
“The percentage of allocation of sale spaces is minimum 20 percent of the total spaces with existent sales. The commercialization in detail of products from the agricultural sector obtained on the own house holding/farm by the agricultural producers as individuals is made on the basis of the id and the commercialization card of products in the agricultural sector”, it is shown in a document according to Agerpres.
The draft also provides the procedure of obtaining the producer certificate, respectively of the document which confirms the capacity of the owner to run an economic activity in the agricultural sector and the regime of using the commercialization card of the products in the sector.
In the present draft of normative act were not provided data on the access card on the markets for producers.
According to the draft, the producer certificate contains information and data on the legal ground of the certificate release, the first and last name of the agricultural producer, the name of products and the surface of the exploited field, respectively the effectives of animals, which are registered in the Agricultural Register owned by the administrative territorial unit or subdivision on whose range is the farm or the house holding, the production estimated to be obtained and addressed to the commercialization process.
The validity of the producer certificate is one year since the date of release.
Also, the draft provides the regime of preparation and utilization of the commercialization card of products from the agricultural sector, respectively of the document used by the individual who owns the producer certificate, for using this document of commerce by wholesale or detail, of agricultural products obtained in his own farm or house holding.
Printing the commercialization cards of products from the agricultural sector is the responsibility of county councils, which distributes to the administrative territorial units/subdivisions at their request.
The penalties provided in this draft for individuals or legal persons show that by non respecting the provisions from this normative act are penalized with fines between 1000 and 5000 lei.
Also, for markets managers is provided a fine starting 10000 and up to 15000.
The producer certificates issued on the basis of the Government Decision nr. 661/2001 can be used until the expiration of the validity period of the applied visa on these, but no later than December the 31st 2013.
