Positive drug-tested drivers will not be prosecuted until the forensics come back

Drivers who test positive in a drug test will not have a criminal case filed within 72 hours until the results of the biological samples arrive from the forensic medical institutions, but only an administrative act, which is attached to the file, Romanian Police said.
If the police officers receive a negative result from the forensic medical services within that period, it is attached to the basic paperwork, and the documents are forwarded by the police to the competent prosecutor's office, with a proposal to close the procedure administratively, a statement issued by the Romanian Police said.
Thus, the person tested with a negative forensic medical examination result is not investigated by the police in any form in a criminal case.
If the forensic medical examination result is positive, it is attached to the basic paperwork and the documents are sent to the competent prosecutor's office and a criminal case is opened, in which investigations are continued and evidence is administered, according to the Criminal Code and the Code of Criminal Procedure, the Police added.
