The judges of the Constitutional Court decided by majority vote that the National Education Law, which was adopted after the Government had taken responsibility for it, is constitutional and will be sent to the president for promulgation.
The Constitutional Court dismissed as inadmissible the challenge of the President of the Senate, Mircea Geoană, and the one made by 108 deputies from the Democratic Social Party (PSD), the Conservative Party (PC) and the Liberal National Party (PNL), admitting that the Education Law is pursuant to the provisions of the Constitution.
The decision was taken with seven votes ‘for’ and two ‘against’.
It is for the third time that the Education Law has been brought to the Constitutional Court’s attention.
The Government took responsibility in Parliament for the Education Law on October 28th, 2010.
Even since the regulatory act was submitted to the Parliament, on October 19th, the President of the Senate requested the Constitutional Court to admit the existence of a constitutional judicial conflict between the Parliament and the Government, taking into account that there is already a similar project under debate in Parliament.
In the same time, after the Government took responsibility for it on October 29th, a motion of censure was submitted by the PSD-PDL, entitled ‘The National Education Law, an anti-education and anti-Romanian law’.
