Prosecutors of the Romanian National Anticorruption Directorate (DNA) consider the statements made today by the Romanian Justice Minister Tudorel Toader in reference to the ongoing criminal investigation known as the "Belina file" to be a form of interference in the work of the prosecutors, and call the Superior Magistrates Council to analyze whether the allegations are likely to affect the independence of the Judiciary.

While answering the questions of the journalists, the Minister of Justice induced the idea that prosecutors do not work within the legal framework, accuses DNA, which explains - in a press release - that public confidence in the work of the Directorate may be affected.

Responding to the issue of law in the Minister's statements, the DNA reminds of a Supreme Court 2014 decision, according to which the act of a minister promoting a governmental decision to unlawfully move a real estate from the public domain into another form of public property, producing a patrimonial advantage to a commercial company, is abuse of office.

It is also invoked the recent decision of the Constitutional Court on the impossibility of opening a criminal investigation in connection with the issuing of an emergency law or ordinance, arguing that it does not apply to government decisions.
